GENERAL PROVISIONS

 

These conditions are exclusively valid between the company Internetbusiness s.r.l - VAT IT17111271007, hereinafter referred to as Dvdland, and anyone who makes online purchases on the website www.dvdland.it, hereinafter referred to as "CLIENT". These conditions may be subject to modifications, and the date of publication on the website corresponds to the date of entry into force.

These conditions govern purchases made on the website www.dvdland.it, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014 and Legislative Decree no. 70/2003 on e-commerce.





ARTICLE 1 - SUBJECT OF THE CONTRACT

 

Under these general sales conditions, Dvdland sells and the CLIENT purchases remotely the tangible movable goods indicated and offered for sale on the website www.dvdland.it. The contract is concluded exclusively via the internet, through the CLIENT's access to www.dvdland.it and the completion of a purchase order according to the procedure provided on the website.

Before confirming the order, the CLIENT undertakes to review these general sales conditions, particularly the pre-contractual information provided by Dvdland, and to accept them by ticking the appropriate box.

In the order confirmation email, the CLIENT will also receive the link to download and store a copy of these general sales conditions, as required by Article 51 paragraph 1 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

 

 

 

ARTICLE 2 - PRE-CONTRACTUAL INFORMATION FOR THE CONSUMER - ART. 49 OF LEGISLATIVE DECREE 206/2005

 

Before the conclusion of the purchase contract, the CLIENT examines the characteristics of the goods, which are illustrated in the individual product sheets at the time of the CLIENT's selection.

 

Before validating the order with an "obligation to pay," the CLIENT is informed of:

 

- the total price of the goods, inclusive of taxes, with details of shipping costs and any other charges;

 

- the payment methods;

 

- conditions, terms, and procedures for exercising the right of withdrawal (Article 6 of these conditions), as well as the withdrawal form provided in Annex I, Part B of Legislative Decree 21/2014;

 

- information that the CLIENT must bear the return shipping costs in the event of withdrawal;

 

- the existence of the legal warranty of conformity for the purchased goods;

- after-sales assistance and commercial guarantees provided by Article.

 

At any time and, in any case, before the conclusion of the contract, the CLIENT may obtain information about Dvdland, including its geographical address, phone and fax numbers, email address, which are also provided below:

ARTICLE 3 - CONCLUSION AND EFFECTIVENESS OF THE CONTRACT

 

The sales contract is deemed concluded with the sending of a confirmation email from Dvdland to the CLIENT. The email contains the CLIENT's details, the order number, the price of the purchased goods, shipping costs, the delivery address, and a link to print and store a copy of these conditions. Shipping costs are intended for the entire order in a single shipment. If the order is split into multiple deliveries, the CLIENT must request it, and this will necessarily include a recalculation of shipping costs for each requested and completed shipment.

The CLIENT undertakes to verify the accuracy of the personal data contained in the email and to promptly inform Dvdland of any corrections or modifications to be made.

Dvdland strives to describe and present the items sold on the website as accurately as possible. However, some errors, inaccuracies, or small differences between the product displayed on the website and the actual product may occur. Additionally, the product images presented on www.dvdland.it do not constitute a contractual element, as they are considered illustrative only.



ARTICLE 4 - PRODUCT AVAILABILITY

 

The availability of the products refers to their actual availability at the time the CLIENT places the order. However, this availability should be considered indicative, as:

- products may be sold to other CLIENTS before order confirmation, due to the simultaneous presence of multiple users on the website;

 

- there may be an information anomaly that makes a product available for purchase when it is not actually available.

 

- For products marked as "not immediately available," an estimated delivery date is provided. This is a predicted and non-binding date; Dvdland cannot assume responsibility for the predicted delivery date, as it is an average delivery time and depends on the producers/distributors. The client purchasing the product is fully aware that the date may not be respected.

Even after sending the order confirmation email from Dvdland with products that are apparently all available, cases of partial or total unavailability of goods (product defects, warehouse errors, etc.) may still occur. In such cases, the order will automatically be rectified with the removal of the unavailable product(s), and the CLIENT will be immediately informed via email; this email will also provide information on how and when to refund any amounts paid.


IMPORTANT NOTE: In an order containing both available and unavailable products, with postponed availability, Dvdland, at its sole discretion, may ship the available goods without notice and without waiting for the unavailable items, provided the shipping costs remain unchanged.

 

ARTICLE 5 - PAYMENT METHODS

 

Any payment by the CLIENT may only be made using the credit cards indicated on the website www.dvdland.it, by bank transfer, via Paypal, or cash on delivery (if offered to the client).

For credit card payments, the actual debit of the order amount will occur not immediately but upon confirmation of the order.

For products indicated on their respective pages as immediately available, upcoming, Limited Edition, Indie Exclusive, RSD, in stock with the producer, once the payment is collected, the order can no longer be canceled.

For Paypal payments, the actual debit will occur not at the time of the order but later.

Payment-related communications and the data provided by the CLIENT at the time of payment are transmitted over secure lines. The security of credit card payments is guaranteed by VBV (Verified by VISA) and SCM (Security Code Mastercard) certifications.



ARTICLE 6 - PRICES

 

All sale prices for the products listed on the website www.dvdland.it are expressed in Euros and include VAT and, where applicable, the WEEE contribution.

Shipping costs are not included in the purchase price but are indicated and calculated at the end of the purchase process before payment is made.

 

The CLIENT accepts Dvdland's right to modify its prices at any time; however, the goods will be invoiced based on the prices indicated on the website at the time of the order's creation and indicated in the confirmation email sent by Dvdland to the CLIENT.

In the case of a computer, manual, technical, or any other error that causes a substantial, unintentional change in the retail price, rendering it exorbitant or clearly negligible, the purchase order will be considered invalid and canceled, and the amount paid by the CLIENT will be refunded within 14 days from the cancellation date.



 

ARTICLE 7 - RIGHT OF WITHDRAWAL

 

In accordance with current legal provisions, the CLIENT has the right to withdraw from the purchase without penalty and without providing any reason, within 14 days from the date of receipt of the products.

 

The CLIENT who intends to exercise the right of withdrawal must notify Dvdland through an explicit declaration, which can be sent by registered mail with return receipt.

In case of exercising the right of withdrawal, the CLIENT is required to return the goods within 14 days from the day on which they communicated to Dvdland their decision to withdraw from the contract, as per Article 57 of Legislative Decree 206/2005.

The goods must be returned to Dvdland, Via Michele Rosi 333 - 00054 - Fiumicino Roma.

The goods must be returned intact, in the original packaging, complete in all parts (including packaging and any accompanying documentation and accessories: manuals, cables, etc.) and with the attached fiscal documentation. Subject to verification of compliance with the above, Dvdland will refund the amount of the products subject to withdrawal within a maximum period of 14 days.

 

As regards the return of the product subject to withdrawal, Dvdland guarantees its clients the possibility of using a courier contracted by Dvdland. Should the CLIENT decide to use this service, the shipping costs (excluding any phone booking fees) will be borne by Dvdland (Article 56 co.1 of Legislative Decree 206/2005), which will subsequently deduct these from the refund amount. Should the CLIENT choose to use another carrier or another means of shipment, all shipping costs will be borne by the CLIENT (Article 56 co. 2 of Legislative Decree 206/2005).

As provided by Article 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, Dvdland may withhold the refund until it has received the goods or until the CLIENT has demonstrated that they have sent the goods back to Dvdland.

 

 

Dvdland will refund the CLIENT, preferably using the same payment method chosen by the CLIENT during the purchase. In case of payment by bank transfer, and should the CLIENT wish to exercise the right of withdrawal, they must provide Dvdland, by accessing the contact section, with the bank account details: IBAN, SWIFT, and BIC, necessary for the refund to be processed by Dvdland.

* It is understood that in the event of a product defect, shipping costs will always be borne by Dvdland.



ARTICLE 8 - LEGAL WARRANTY OF CONFORMITY

 

In the event of receiving defective or non-conforming products to the placed orders, the CLIENT is entitled to restore the product’s cost through repair or replacement of the product free of charge. The CLIENT can exercise this right if the defect occurs within two years from the delivery of the goods and if the CLIENT reports the defect to Dvdland within two months of its discovery.



ARTICLE 9 - COMMERCIAL WARRANTY

 

To take advantage of the warranty, the CLIENT must keep the invoice.



ARTICLE 10 - DELIVERY METHODS

 

For every order placed on the website www.dvdland.it, Dvdland issues an invoice for the shipped goods. The invoice is available and printable after the order is processed. Once the invoice is issued, it cannot be reissued.



 

 

ARTICLE 11 - RETURNS FOR DEFECTIVE PRODUCTS

 

When a product has an objective defect that prevents correct use and thus precludes its functionality (this does not include packaging damage), the client may request a return by communicating via email, phone, or WhatsApp,

after completing the DEFECTIVE PRODUCT RETURN AUTHORIZATION FORM. This form must be filled out and submitted to obtain return authorization, and a copy must be included in the return package.

Once the return is authorized, we will send a courier to collect the item at no cost to the client.

Once the product is collected, it will be inspected, and if the defect is confirmed, the client will be reimbursed the full amount spent.

In the return request, it is necessary to indicate: the brand and model of the player/turntable, chapter and minute (for audiovisual products), or side, track, minute, and second (for audio products). These same details must be provided, once the return is authorized, inside the package handed to the courier, along with the client’s full name and order number.

If the defect is not confirmed, the client will be required to cover the collection and return costs of €15.98 plus €5 for the inspection fee.

IMPORTANT RETURN NOTICE FOR VINYL RECORDS:

In more than 97% of return requests, the issue encountered is not due to the vinyl record. Most of the time, the cause of the "defect" can be attributed to one or more of the following elements: incorrect needle weight setting, incorrect anti-skating setting, extremely low-quality turntables (e.g., all-in-one turntables, suitcase-style models, etc.), which may struggle to read certain records correctly. We invite you to carefully check these elements before requesting a return.

If the return request does not concern defects that preclude or limit the use of the purchased item (e.g., imperfections related to the packaging), the return may be accepted with the shipping and reshipping costs borne by the client.

 

 

 

 

ARTICLE 12 - PRE-ORDER PRODUCTS

 

Pre-order products are items that have a future release date indicated.

Orders containing pre-order products are binding and cannot be canceled or modified. Once an order for a pre-order product is placed, a refund cannot be requested, regardless of the reason.

If you are not satisfied with your pre-order product, you can contact customer service for information about return or exchange options. However, please note that a return or exchange is not guaranteed.
